In the matter of reopening of Abpara Chowk, the plea deal of exemption from attendance by Defense Secretary and DGI ISI has been accepted at the hands of Justice Shaukat Aziz Siddiqui, Islamabad High Court (IHC).
On Tuesday, 3rd July 2018, a miscellaneous petition came up for hearing before a single bench of IHC led by Justice Shaukat Aziz Siddiqui. The petition which came from the Ministry of Defense and DG ISI, was about a case of an illegal bus terminal in Faizabad. Through this petition, the court was requested to review the decisions of June 22 and 28.
Last Friday, IHC summoned the Director General (DG) of Inter-Services Intelligence (ISI) and the Defense Secretary on 4th July, 2018 in a case pertaining to encroachments in the federal capital’s Aabpara locality. While dealing with this, the court also shed light on the matter of road blockage by two private TV channels. This blockage was caused due to the renovations being carried out at the premises.
Remove the encroachments and file report thereof in the court. The representative of Defense Ministry and DAG should sign the written orders of today’s court proceedings.” As this blockage case came to an end, the court disposed of this miscellaneous petition.
Director of CDA, Syed Jawad Muzaffar talked about the complaints of illegal construction received earlier and the requirements of fresh demarcation through land survey department. Depending upon validity of the complaint, further implementations were promised of the removal of this encroachment.

Officials of Islamabad Capital Territory, CDA, and senior superintendent of police (SSP) Traffic were to appear before the court to make statements on steps taken to remove the encroachments. On 4th July, a miscellaneous petition from Ministry of Defense and DG ISI came up for hearing before single bench of IHC led by Justice Shuakat Aziz Siddiqui in the illegal Faizabad bus terminal case on Tuesday.
The court was moved through this petition to review its June, 22 and June 28 decisions. As the case commenced, representatives of Ministry of Defense and Deputy Attorney General (DAG) appeared before the court requesting that more time be given for establishing alternative security arrangements setting aside June 22 and 29 decisions.

These pleas of defense were rejected at the hands of the judge, as the proprietors tried to seek nullification of June 22 and 29 decisions. They remarked, “We are not fond of summoning. This was said that we have no powers. Therefore, those having powers were summoned.”

Justice Shaukat Aziz Siddiqui remarked, “Alternative security arrangements mean what? Nothing is substitute. Make arrangements for security within your limits.” He also stated that, “We give the time for four weeks.
Open the road, remove the encroachments and file report thereof in the court. The representative of Defense Ministry and DAG should sign the written orders of today’s court proceedings.” As this blockage case came to an end, the court disposed of this miscellaneous petition.
