Nawaz’ contemptuous remarks make sense and so does superior Judiciary’s hesitation

Nawaz Sharif, the former Prime Minister of Pakistan, is continuing with his anti-judiciary campaign, despite a ban by the Lahore High Court in this regard and without any directives by the Supreme Court of Pakistan, however, it seems that both the former premier and superior judiciary are playing smartly.

Nawaz Sharif, who was disqualified by a five-member bench of the top court in Panama Papers Case, spoke on many occasions, against the judges of apex court who disqualified him and against Mian Saqib Nisar, the Chief Justice as well, however, the Chief Justice did not issue any contempt of court notice to him, though it summoned three lawmakers, close to Nawaz Sharif.

The core reason behind Nawaz Sharif’s outlandish remarks against chief justice seems to be confusing the masses over the legal procedures initiated in the purview of accountability court proceedings.

Even on Monday, as Nawaz Sharif arrived from London and appeared before the accountability court, he accused the top judge of having imposed a judicial martial law.Nawaz Sharif, who has served as prime minister thrice, categorically expressed that dictatorship was prevalent in the country under the Chief Justice.

Although Mian Saqib Nisar was not among the judges who ousted Nawaz Sharif, even then, the former Prime Minister has focused his anger towards the top judge, leaving behind the five judges unscathed, who disqualified him.

But Nawaz Sharif’s anger towards the top judge is well justified in the prevalent circumstances, not because he is being subjected to injustice, but because he is waiting to get a contempt of court notice.

In the present scenario, Nawaz Sharif is trying to create a perception of having a public support against the judiciary, and having received a contempt notice would further boost his narrative that he was being singled out, contrary to the on ground situation.

Nawaz Sharif had also fired a broadside at the Chief Justice for his visits to hospitals; his daughter Maryam directly referred to ‘My Lord’ and held him responsible, if anything bad happens to Nawaz Sharif, over striping him off the additional security.

The Pakistan Muslim League Nawaz’ blatant outrage started against the top judge after he disqualified Nawaz Sharif from holding party office, despite Pakistan Muslim League Nawaz’ bid in the passing of Election Act 2017.

Moreover, as Nawaz Sharif is facing corruption charges in the references filed by the National Accountability Bureau, he is not firing a broadside at the accountability court judge Muhammad Bashir, but his tirade against the chief justice is intensifying with each passing day.

On the other hand, the superior judiciary is also playing smartly by not prosecuting Nawaz Sharif for contemptuous remarks.Though the Lahore High Court has banned the broadcast of anti-judiciary remarks, it has not singled out Nawaz Sharif and Maryam Nawaz.

The Supreme Court is also hesitant to summon Pakistan Muslim League Nawaz ‘Quaid for life’ apparently due to the reason that it does not want to create any impression of Sharifs being pushed against the wall.

Nawaz Sharif had, at one point, expressed that judges were holding a grudge against him; however, the top court did not summon him for casting aspersions about the image of judiciary.

The top court has sentenced Nehal Hashmi, the former Senator, to one month in jail besides disqualifying him. It is also trying Nawaz Sharif’s close confidantes and federal ministers Tallal Chaudhry and Danyal Aziz, but it is falling short of prosecuting Nawaz Sharif.

What give credence to the fact that Nawaz Sharif’s basic rights are not being violated is the directive of Chief Justice, who has restored the security provided to the former prime minister.

The Chief Justice of Pakistan had also remarked during the hearing of a suo moto notice related to Lahore High Court’s ban that Nawaz Sharif and his daughter could speak, whatever they want, before the court, however, he is smartly avoiding to issue contempt notice to the former prime minister.

The Chief Justice is well aware of the fact that the disqualified Prime Minister would take a strong stand to the contempt of court proceedings and the whole progress made by accountability court would be derailed, so he is avoiding initiation of contempt proceedings at him.

What give credence to the fact that Nawaz Sharif’s basic rights are not being violated is the directive of Chief Justice, who has restored the security provided to the former prime minister.

On the surface, it is visible that the top court would not issue contempt of court notice to Nawaz Sharif, though he would keep asking for it, so both the judiciary and Nawaz Sharif are trying to outsmart each other with scores level, currently.
