EU Considers Regulation for Telegram as User Numbers Approach Threshold

European Union’s Technology Regulator Engages in Conversation with WhatsApp over Telegram’s Rising User Numbers

The European Union’s technology regulator is currently in talks with WhatsApp as the number of users on the messaging service Telegram approaches the threshold that could subject it to stricter regulations under the Digital Services Act (DSA). The European Commission made this announcement on May 28th, stating that they are engaging in a conversation with WhatsApp to obtain more specific information about the situation.

The DSA, which came into force the previous year but has not been fully implemented yet, applies to all intermediaries and online platforms. It sets out regulations that smaller technology companies must adhere to, including monitoring the content on their platforms more strictly. These obligations are more stringent for smaller companies compared to their larger counterparts in the industry.

Over the past six months leading up to February, at least 41 million individuals in the European Union used Telegram, according to various sources. Although this number is below the threshold of 45 million users set by the DSA, it is still significant. As the number of users approaches or exceeds the specified requirements, Telegram may be classified as a very large online platform (VLOP) and be subjected to even stricter duties and responsibilities.

In addition to Telegram, other online platforms recognized as VLOPs include Google (owned by Alphabet), Amazon, Apple, Meta Platforms, Microsoft, AliExpress, Snap, Pinterest, TikTok (owned by ByteDance), Zalando, and three pornographic websites. These platforms have already been acknowledged as falling under the VLOP category.

The European Commission is closely monitoring these developments and coordinating with digital service coordinators. The conversations with WhatsApp and Telegram are part of their efforts to ensure compliance with the DSA and protect users from unlawful or harmful content.
