US Threatens ICC to Shield Israel from Accountability

The U.S. is threatening sanctions and military action against the ICC to shield Israeli leaders from war crimes accountability in Gaza.

The International Criminal Court (ICC) is under siege, facing brazen threats from the United States, which seeks to shield Israel from accountability for its ongoing genocide in Gaza. ICC President Tomoko Akane, in a stark warning to member states, condemned coercive measures and threats that “jeopardize the court’s very existence.” Addressing the tribunal’s annual conference in The Hague, Akane highlighted how Washington’s actions undermine global justice and the rule of law.

This campaign of intimidation escalated after the ICC issued arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for war crimes in Gaza. These unprecedented warrants mark the first time the court has targeted senior officials of a Western ally for crimes against humanity. Israel’s genocidal campaign in Gaza, which has killed over 44,000 Palestinians, mostly women and children, underscores the urgent need for accountability. Instead of supporting justice, the United States has chosen to actively sabotage the court.

Weaponizing Sanctions to Protect Israel

US politicians, emboldened by their staunch alliance with Israel, have launched a ferocious assault on the ICC. Republican Senator Lindsey Graham has openly threatened sanctions against any ally, including Canada, Britain, France, or Germany, that cooperates with the tribunal. “You’re gonna have to pick the rogue ICC versus America,” Graham declared, demonstrating the US’s prioritization of Israeli impunity over international law. Such threats are not hollow. Washington has a history of targeting the ICC, imposing travel bans and asset freezes on court officials in 2020 to block investigations into US war crimes in Afghanistan.

The Republican-controlled Congress has already passed legislation to sanction the ICC, and these measures are expected to intensify once Republicans assume control of both houses in January. Senator Tom Cotton, another Republican, even suggested military action against the ICC to prevent the enforcement of the arrest warrants. These extreme responses reveal the lengths to which Washington will go to protect its allies from prosecution.

Hypocrisy on Display

The US’s response to the ICC’s actions exposes glaring hypocrisy. While President Joe Biden called the arrest warrant for Russian President Vladimir Putin over war crimes in Ukraine “justified,” he denounced the court’s actions against Israeli officials as “outrageous.” This selective application of justice demonstrates that the US views international law as a tool to wield against adversaries, not allies.

France and Germany, both ICC member states, have expressed lukewarm support for the court’s actions against Israel, further highlighting Western duplicity. While these nations supported the warrant for Putin, they hesitated when it came to holding Netanyahu accountable, citing concerns about “immunities” and the “complexities” of the situation. Such equivocation erodes the court’s credibility and emboldens perpetrators of atrocities.

Genocide and Impunity in Gaza

Israel’s genocidal war on Gaza, following Hamas’s October 2023 cross-border attack, has devastated the Palestinian enclave. The relentless bombardment has displaced millions and reduced entire neighborhoods to rubble. Despite mounting evidence of war crimes, including targeting civilian infrastructure and committing collective punishment, Israel continues its campaign with impunity. The ICC’s arrest warrants for Netanyahu and Gallant represent a rare glimmer of hope for justice, but Washington’s interference threatens to extinguish it.

Akane warned that dismantling the ICC would signify “the fall of the rule of law in the international community.” Victims of war crimes would lose their only avenue for justice, and a world without the ICC would be one where the powerful act without consequence. “For many victims, a world without the ICC is inconceivable,” she declared.

A Global Call for Accountability

The international community must resist US efforts to sabotage the ICC. Countries like France, Germany, and Canada must demonstrate true commitment to justice by defying Washington’s threats and upholding their obligations under the Rome Statute. The ICC’s mandate to prosecute war crimes, crimes against humanity, and genocide is crucial for maintaining global order. Without it, perpetrators like Netanyahu will continue their atrocities unchecked.

The US’s actions also raise critical questions about the future of international justice. If the ICC succumbs to these threats, it will set a dangerous precedent, signaling that powerful nations can bully their way out of accountability. The global community must rally behind the ICC to preserve its independence and legitimacy.

The ICC stands at a crossroads. Its decision to hold Israel accountable for genocide in Gaza is a landmark moment in the fight for international justice. However, Washington’s coercive measures threaten to derail this progress, exposing the court to unprecedented pressure. The world must choose between justice and impunity, between upholding the rule of law and surrendering to the dictates of the powerful.
